Through holding medical providers accountable under recently enacted federal law—the Hitech Act—Todd obtains his client’s records in electronic form at a much-reduced cost over what Indiana law would otherwise allow. Although this requires more work than it would to simply advance the costs his clients would otherwise be responsible for, Todd believes holding medical providers accountable to the law is just as important as holding accountable those who caused his client’s injuries. When a provider fails to cooperate, Todd takes the necessary step of threatening the recalcitrant provider with an enforcement action by the Department of Health and Human Services.
